Until recently, the conventional wisdom was that government purchases of goods essentially escaped multilateral trade disciplines unless the purchases were covered by the WTO's plurilateral Agreement on Government Procurement (GPA). As it turns out, conventional wisdom was overly dismissive of the role of the GATT 1994 in regulating government purchases, as confirmed by the Appellate Body's decisions in Canada -Renewable Energy and Canada - FIT Program. While Article Ⅲ:8(a) of the GATT 1994 sets out a derogation from the national treatment obligation for government procurement, this derogation is narrower than what was commonly thought. The Appellate Body's interpretation of Article Ⅲ:8(a) has important implications particularly with respect to the scope that WTO Members have to discriminate in their government purchases and to use government procurement to pursue industrial policies not just in the renewable energy sector at issue in these disputes, but in other sectors as well.
