A federal appeals court on Friday denied EPA's bid to dismiss a wetlands case against an Idaho couple that has previously reached the Supreme Court. After more than a dozen years of litigation, the Trump administration in March sought to drop the lawsuit against Michael and Chantell Sackett concerning whether they violated the Clean Water Act when they developed land that included a wetland (Greenwire, March 31). The case addresses the fundamental issue of what wetlands and streams qualify for federal protections under the Clean Water Act.
