A pair of conservation groups yesterday promised to fight the Fish and Wildlife Service over its decision earlier this year to not protect an elusive, forest-dwelling carnivore under the Endangered Species Act. The notice of intent to sue from the Center for Biological Diversity and the Environmental Protection Information Center argues that Fish and Wildlife's conclusion that the coastal marten "is not threatened or endangered throughout at least a significant portion of its range is contrary to the best scientific and commercial data available and is arbitrary and capricious." The groups warned that "we intend to pursue legal action in federal court to challenge the Service's 'not warranted' listing decision."
