Why are environmental consultants reluctant to sign reliance letters for environmental site assessments after brownfields remediation? And if you, as a purchaser, lender or other third party, get a reliance letter, does it really give you what you need? In the August/September 2004 issue of HazMat Management, an article pointed out that consultants often resist signing reliance letters. (Re: "Consultant's Reliance Letters," page 16.) The authors argued that consultants are becoming more "unreasonable and difficult" to deal with, when asked for reliance letters. They recommend that their commercial clients negotiate reliance letters before a consultant starts work, when the consultant is most vulnerable, and the client has the most leverage. Third parties regard reliance letters as an inexpensive and quick due diligence shortcut. Inexpensive, because the third party does not have to hire its own consultant. Quick, because there is no delay to do an investigation and write a report. The third party simply relies on work that the con- sultant did for someone else.
