The debate about legally flying with something broken or missing is one of the more misunderstood and most abused corners of the FARs—probably because the answer is neither universally agreed on nor entirely logical. The first step of assessing airworthiness with something missing or broken is easy: If the equipment is required by FAR (such as in 91.205's required instruments), by any part of the flight manual, or by other document (such as an AD or the aircraft type certificate data sheet), you must have it installed and working. (We'll set aside special cases like ferry permits for this discussion.) Presuming it's not on that list, you fall under FAR 91.213.
