The operator of an Internet portal that customers can use to book flights through an agency does not infringe the prohibition on obstructing competition pursuant to Sec. 4(10) of the Act Against Unfair Competition even if the freely accessible flight data on which the agency is based is acquired by means of an automated query to the airline's website (known as screen scraping) and the operator of the Internet portal enters a tick during the booking process to confirm its agreement to the airline's terms of use, which prohibit such an automated retrieval of flight data.
