The judgment of the Spanish Supreme Court of 8 June 2012 is the first case in which the highest court of Spain provides for a redress of the victims of a cartel of a global amount of €1.1 million. The sugar manufacturer Acor Sociedad Cooperativa General Agropecuaria, one of the members of the Spanish Sugar Cartel, appealed the judgment of the Valladolid Provincial Court of 9 October 2009, which had granted the mentioned damages totalling €1.1 million to the claimants, nine producers of biscuits and confectionary (Nestle Spain, Gullon, Zahor and others). All the claimants were direct purchasers of sugar and, therefore, they had been victims of the sugar cartel between 1995 and 1996. They brought a follow-on damage claim based on the decision of the former Spanish competition authority (Tribunal de Defensa de la Competencia), dated 25 April 1999, which had fined the sugar producers for illegal price fixing and market sharing arrangements infringing the cartel prohibition in Art. 1 of the Spanish Competition Act and Art. 81 EC Treaty (now Art. 101 TFEU). In its decision the Spanish competition authority inter alia concluded that "sugar is essential in the food industry" and therefore "the damage is very serious".
