France, the first European country to legislate directly on the important but delicate question of file-sharing on the internet, recently adopted a complete body of regulation to combat downloading through peer-to-peer networks. The result of three laws and a multitude of implementation decrees, the system is extremely complex, expensive and risks being very difficult to apply. Despite a declared intention to give priority to an educational and preventive approach, the legislature finally adopted a regulation with a high repressive potential, due principally to the possibility of cumulating administrative and criminal penalties. Therefore, the compatibility of the proposed system with the European Convention on Human Rights remains doubtful, especially in the light of the disproportionate nature of the possible infringements of fundamental rights that might result.
