House Strengthens Ban On DOD Procuring Goods, Services From China

The House has passed legislation that tightens the Defense Department's ban on procuring items from Chinese companies by requiring a report when DOD seeks to waive the prohibition for critical items. An amendment included in the House's fiscal year 2012 defense authorization bill would update FY-06 statutory language that prohibits buying items from "communist Chinese military companies." The new language states that the defense secretary may waive the prohibition if the "good or service is critical to the needs of the Department of Defense and is otherwise unavailable" to DOD. The prior wording stated that the defense secretary could waive the ban if "the secretary determines such a waiver is necessary for national security purposes." Under the prior language, the defense secretary must notify the congressional defense committees of each waiver; but the new proposed language would require a report be submitted to Congress at least 15 days prior to the waiver that identifies the reasons for the waiver and "includes recommendations as to what actions may be taken to develop alternative sourcing capabilities in the future."
