Recently, in Kirtsaeng v.John Wiley & Sons, Inc., the Supreme Court of the United States held in a 6-3 decision that the "first sale" doctrine of U.S. copyright law applies to copyrighted works lawfully made and first sold outside the U.S. This decision has important implications for companies that rely on copyright protection for materials produced outside the U.S. or that are in the business of reselling those materials, including technology companies, book, video game and music publishers, fashion and cosmetics companies and consumer goods retailers.
