摘要

Although project finance has not previously been used as a method to finance a company devoted to creating and exploiting intellectual property (an invention company), the time is now ripe for such an undertaking. Recent developments in US law and intellectual property markets have made patents more liquid, and many firms that would play supporting roles to an invention company have arisen. Invention companies financed through other means exist and appear to be successful; project finance should provide new capital for this business model and increase its profitability. In addition, the risks associated with an invention company can be reasonably mitigated. Finally, joint ventures formed from existing corporate research divisions and public-private partnerships created to solve environmental problems might be the most likely scenarios to first inspire the formation of an invention company's using project finance.rnThis article by Richard Bis first presents an overview of the developments in the IP market that provide the foundation for the feasibility of a successful invention company. Additionally, it presents a qualitative study of the benefits and risks to such a financing strategy and focuses on the means of production of, risks to, and mitigation techniques for preserving therncritical cash flow of the invention company. Finally, the article presents and evaluates a few scenarios that are the most likely to benefit from project financing.
