The U.S. Court of Appeals for the District of Columbia Circuit recently vacated a much-discussed and widely-reported Federal Trade Commission (FTC) decision that found that computer memory developer and licensor Rambus Inc. had unlawfully monopolized the market for certain memory technologies by participating in a standard-setting organization (SSO) without making required disclosures of its intellectual property rights. In so doing, the circuit court called into question the future course of a developing line of antitrust precedents governing antitrust liability for misconduct, particularly deception in connection with the work of industry standard-setting organizations.
