摘要

Can a patent holder require prospective licensees to license packages of patents for a single royalty, or is the patent holder required to allow its licensees to choose the individual patents that they wish to license? In general, a patent holder tying a patent license to the licensee's purchase of another product may be liable per se for patent misuse, rendering the patent unenforceable. In U.S. Philips Corp. v. International Trade Commission,1 the Federal Circuit, reversing a decision of the US International Trade Commission (ITC), held that a package patent license is not a tying arrangement that gives rise to per se patent misuse.
