A German specialty chemicals company has become the first to complain to the Board of Appeal of the European Chemicals Agency (ECHA) about an administrative fee levied under the European Union's REACH law. 5N PV GmbH, which produces pure metals such as antimony and cadmium and compounds such as cadmium sulfide, said the €20,700 ($28,280) administrative charge was not founded on a clear legal basis and was disproportionate with "a punitive character." ECHA did not provided clear information about its charges and fees, the company said. According to a summary posted on the ECHA website Sept. 14, the administrative charge was levied because 5N PV applied to be treated as small or medium-sized (SME) enterprise when determining its registration fee but was subsequently found to be "large." SMEs pay significantly lower fees than large companies.
