FACTS: An engineer expert takes an assignment on a tort liability case where the plaintiff drove off the roadway on a low-volume (90 average annual daily traffic) local road on a hillside. The roadway was constructed in the 1930s and widened over the years through maintenance activities providing a 26-foot, two-lane, gravel roadway. The roadway had curvilinear alignment along the hillside with a posted speed limit of 35 miles per hour (mph) and no guardrail on the edge of the roadway. The plaintiff states that he lost control of the vehicle in the gravel, causing him to veer off the roadway.
