The author has devoted many years to representing airmen and aircraft operators in litigation before the NTSB and also before the FAA. During thirty-two years of practicing law, the author has observed substantial erosions in the rights of airmenrnto receive due process of law. Over the past few years, there has been an acute departure by the Board from binding precedent in a climate where ad hoc decisions are increasingly the rule, not the exception.
