In the last decade, the electricity supply industry (ESI) of Nigeria has witnessed unprecedented attention from the government. With the attention has come immense scrutiny into the policies that surround the industry and the implementation of existing policies. Its apparent and perceived inefficiencies and its policy direction have led to heated debate. Various questions about the underlying motives of policy-makers have arisen, most notably: what are they doing and what should they do differendy? Focusing on the legal regime, regulatory framework and the level of implementation of the law and regulation, this article examines the formulation of Nigeria's power sector liberalisation initiative, the response of the players to those initiatives, the level of implementation, the areas of weaknesses and the way forward. It examines the regulatory framework in the industry and how the deliberate policy decision of gradual disengagement of government from the industry is sought to be achieved. In a system bedevilled by actual and perceived uncertainty, and at a time when the government seeks to attract foreign direct investment to improve on the performance of the sector, achieving clarity in the legal and regulatory framework in place in the power sector is crucial.
