1. Section 19a of the German Competition Act provides a new competition instrument for swift and effective intervention against unilateral conduct by selected digital platforms that is deemed anticompetitive. 2. The new instrument addresses operators of two-sided platforms and networks based on qualitative criteria. 3. These criteria are neither cumulative nor fully specified, do not require dominance, and allow for the inclusion of platforms outside the big five (GAFAM). 4. The newly introduced provision lists seven practices that 19a firms can be prohibited from engaging in, subject to objective justification.
