The questioner's letter delves into the issue of whether the carrier assumes the role of shipper when the carrier finds that a hazmat package is leaking and places the leaking package into a salvage package for onward transportation. The questioner's company has the current practice of annotating the original shipping paper but does not issue a new shipping paper. His company contends that "containment of damaged hazardous materials shipments for continued transportation does not turn a carrier into a shipper/offeror, and consequently, the carrier should not be required to generate a new shipper's declaration. PHMSA's response points out that under 173.3(c)(5) when a salvage package is used for a leaking package in transportation, "The shipper shall prepare shipping papers in accordance with subpart C of part 172 of this subchapter." This particular requirement was included in the HM-181 final rule issued in December 21, 1990 but appears to have even predated HM-181. Suffice it to say, it is a very old requirement.
