On February 2, 2010, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a final rule as HM-231: Miscellaneous Packaging Amendments. The interpretation upon which this report is based stems from the changes introduced in that rule. Readers may recall in HM-231 PHMSA adjusted the requirements for closure instructions in Part 178 and shipper requirements for closing a UN package in Part 173. Under requirements in 49 CFR 178.2, a manufacturer is required to identify all of the steps necessary to complete the package so that it will fully conform to the UN performance requirements. In HM-231, PHMSA, out of apparent concern for incidents involving packaging closures, revised the requirement for closure instructions in § 178.2. Under § 173.22 a shipper is required to close the packaging in accordance with instructions provided by the manufacturer. In HM-231, PHMSA also revised the language in § 173.22 for the requirement pertaining to the shipper closing the package.
