The result of the presumption created by the CJEU is a net cast too wide. It certainly catches bad faith users, Web sites such as GeenStijl.nl, which rely on leaks of copyright-protected works to make a profit and which seem to be, in general, fully knowledgeable of the lack of rightholders' authorization. Though one can only speculate, the CJEU's interpretation seems to have been largely motivated by the purpose of capturing this type of user.
