If we therefore accept that it is possible to draft a global Convention on the rights of the online user/the responsibilities of a data collector perhaps the most important question in the current climate is how it would be enforced to ensure we remain free, that those concerned have somewhere independent to go to and the law places the virtual shackles in the right place. It is not an easy task and it requires international cooperation. Domestic legal frameworks have been a poor barrier to cruelty online, indiscriminate collection of data, data analysis by huge corporations in the name of profit and by security agencies in the name of national interest. The clamor for new laws is being heard across the world. The risk for individual freedoms in a kneejerk reaction is grave. The reality is that laws made now, even if made tomorrow, will continue to age. The advantage of a set of principles in a convention is that they can be applied in such a way to ensure that domestic legislation is compatible. Implementation of the European Convention on Human Rights was achieved in the United Kingdom by passing the Human Rights Act 1998. Ignoring for a moment political squabbles about judicial supremacy between the United Kingdom and the rest of Europe, the enactment of a domestic statute was a key tool to require individual judges to consider ECHR rights.
