In recent enforcement actions, the Federal Communications Commission (FCC) has been making a big splash by imposing record fines against telecommunications service providers for alleged failures to adequately protect the privacy of customer information, a surprising development in a regulatory environment where the FTC generally has policed consumer privacy. But an even more surprising development, and one that is not making headlines, is that the FCC is quietly using these enforcement actions to expand its own privacy authority.
