Website Accessibility and the Americans with Disabilities Act

摘要

That Web sites are not "places of public accommodation" does not mean they can or should disregard accessibility. First, as explained in this article, many Web sites come within the ambit of the ADA vis-avis a covered entity. Second, independent of any legal obligation, there are countless reasons grounded in social responsibility, cultivating consumer goodwill, and business strategy to make Web sites fully accessible. In fact, the recent Web site accessibility "wins" in Netflix, VuDu, and Harvard were achieved through settlements and Consent Decrees (albeit motivated by lawsuits). These mechanisms not only permitted disability advocates to help craft meaningful solutions (thereby reducing the risk of future litigation), but also enabled covered entities to better serve and expand their target populations.
