Having surveyed the burgeoning invasion-of-privacy regimes in Canada and considered the manner in which they might evolve, we return to briefly consider how the law could apply to a case involving the tort of Intrusion in the context of email. As it turns out, the answer may well depend on which of the invasion-of-privacy regimes apply. We have shown how, despite divergent origins, courts in British Columbia and Ontario have developed the tort along parallel, and largely equivalent, paths-both using the same US jurisprudence to fill in the scope of just what "invasion of privacy" might entail. However, there is potential for divergence on the issue of consent.
