摘要

It is clear that the modalities presented in the author's 'Lessigan' model both re-enforce each other, but also have been made to work at cross-purposes to each other. Aside from the legal modality (i.e., copyright), the author asserts that the other variable forces in existence have more of an impact on user behavior and any discussion of digital regulation must appreciate this, not only to understand how to regulate effectively, but also to understand why existing regulation may be ineffective. It is not the point of this article to articulate a theory of effective regulation, but to compose a scheme that reflects the complexities of such an issue. It is too simplistic to view the problems allegedly created by digital technology on a one-dimensional axis between the user and the content.
