Owners and operators of Web sites based outside the European Economic Area (EEA) should consider the potential liability for trademark infringement in connection with the dispatch of branded goods to the EEA without the necessary consent of the trademark owner. As recent cases have demonstrated, the UK courts in particular are keen to take a practical approach to such matters, and overseas Web sites seen to be targeting the UK market will not be able to escape liability simply by using an overseas or global domain name.
