DESIGNING AVATARS IN VIRTUAL WORLDS: HOW FREE ARE WE TO PLAY SUPERMAN?

Although cyberspace may be a haven for infringers, virtual worlds are not mere wastelands for digital pirates. They provide grounds for creating our virtual selves, in ways that may be either artistic images or representations imbued with a sense of self, or both. It is a playground where the imagination may thrive if we allow it to. Given the compelling reasons for preserving the rights of player in the creation of their avatars in virtual worlds, courts should be wary of yielding too readily to attempts by copyright owners to protect their intellectual property. Several affirmative defenses exist for online videogame companies, but they do not adequately or reliably safeguard players' freedom to create. Although it is too soon in the short history of virtual worlds to enact a legislative solution to this problem, courts should play an active role in keeping the channels open for creativity and innovation in virtual worlds. A broad view of what constitutes fair use is in order. With that, courts may shape the law of the industry as it sees fit in due time, but online videogame companies would not have to excessively police virtual worlds for fear of liability, nor would players have to overly restrain their creative and expressive energy. In such a supportive gaming environment, players would be able to throw on a Superman costume and role-play in virtual worlds just as freely as they might in the real world.
