The current trade dispute between the United States and Antigua over the US ban on cross-border gambling services is in many ways a dispute about morals. On April 7, 2005, the WTO Appellate Body extensively reversed an earlier panel decision by recognizing for the first time that a trade restrictive measure was exempt from WTO obligations because it was "necessary to protect public morals." It held that, because the US ban on cross-border gambling is necessary to protect the US public from the vices of gambling, the United States is excused from its trade obligations of allowing market access for gambling services. The Appellate Body noted, however, that a federal law regarding betting on horseracing, the Interstate Horseracing Act (IHA), may negate this exception if the IHA discriminates by allowing interstate but not international betting on horseracing. The Appellate Body, therefore, conditioned its public morals exception on the United States ensuring that its federal laws, specifically the IHA, do not discriminate against foreign gambling suppliers.
