As both companies and individuals increasingly rely on computers, property and liability insurance claims involving data as a component of the loss have increased in number. Such claims can arise from a multitude of factual scenarios: a fire that destroys precious data, a power outage or spike that corrupts computer systems, virus-caused data destruction, a denial-of-service attack, data theft, dissemination of electronically-stored private information, or hacking vandalism (internal and external). Whether such claims are subject to coverage is another question on which the Fourth Circuit recently issued an influential opinion, America Online, Inc. v. St. Paul Mercury Insurance Company. Applying Virginia law, the AOL court held that the corruption of data on aggrieved AOL users' computers did not result in "physical damage to tangible property," even if the computers were rendered inoperable. Thus, AOL's insurer, St. Paul, had no duty to defend AOL in underlying lawsuits by injured AOL users.
