What Lawyers Need to Know About the Open Source Licenses

Open source software has become the software that runs the Internet. The majority of Web servers use the Apache Web server software. Many consider Bind to play the most critical role in the infrastructure of the Internet because it translates URLs into IP addresses. Sendmail routes nearly all of our email. Linux often is used as an operating system instead of Windows, especially when reliability is a major concern. The Mozilla browser, the Perl language, and other programming tools are other examples of open source software that have become commonplace in the nuts-and-bolts operation of the Internet. Open source software usually first grabs attention because it is described as free and can be obtained without charge. The implications of open source software, however, go much deeper. The open source movement reflects the intent of its founders to turn traditional notions of copyright, software licensing, distribution, development, and even ownership on their heads, even to the point of creating the term "copyleft" to describe the alternative approach to these issues. In fact, an excellent documentary film made about Linux and the open source movement is called "Revolution OS," in recognition of the dramatic new approach.
