Attorneys today are faced with a vastly different discovery landscape than their predecessors. Paper storage of documents is no longer the model practice. Instead, companies and individuals alike are increasingly turning to electronic storage of information. It is estimated that 93 percent of documents are created electronically. There also are additional estimates that only 30 percent of documents are in hard copy format. For attorneys engaged in discovery, this means that the critical mass of documents and information to be obtained from opposing parties is found in cyberspace and on electronic storage devices. It is no wonder, then, that "lawyers who forsake electronic discovery on behalf of a client due to the costs come 'close to professional negligence.'"
