The existence of the same short phrases and words in two books does not constitute infringement, and the same is true for similar short software modules existing in two operating systems. Of course, if the arrangement of these modules in the second program is virtually identical to the arrangement of the modules in the first program, then there could be copyright infringement. If the copied modules were uniquely designed and were of great significance to the intended audience, then the copyright holder of the first program might successfully claim copyright infringement. SCO, however, does not appear to claim that protected parts of the SCO UNIX operating system are substantially similar overall to the corresponding parts of the GNU/Linux software, let alone virtually identical. Moreover, unlike a character in a video game, such as PAC-MAN, where the screen displays are crucial to the value of the game and could not be redesigned while maintaining the value of the game, in GNU/Linux no particular module is crucial, since developers could redesign that module. As in the Wizard Of Oz, there is no powerful wizard behind the SCO claims. Instead, SCO is attempting to create a law of "nano-copyright" to give greater protection to individual elements of functional computer software than the law allows. SCO's copyright claims appear to be made out of thin air, just as in Hans Christian Anderson's fairy tale the Emperor's new clothes were made out of thin air.
