When Congress enacted the CAN-SPAM Act of 2003, many experts groaned that it would only worsen the spam problem, primarily because it is opt out rather than opt in, and they felt that it was adopted under pressure from email marketers in order to preempt stronger state legislation. One saving grace of CAN-SPAM, they said, was that it called for the Federal Trade Commission (FTC) to investigate the possibility of creating a nationwide do-not-spam registry, to which consumers could submit their email addresses if they did not wish to receive unsolicited commercial emails (UCE). The FTC investigated and, in June 2004, issued a report recommending against the creation of such a registry. Again, groans were heard from many in the spam field.
