On February 20, 2003, the Federal Communications Commission (FCC) decided in a split vote to roll back many of its pro-competitive decisions implementing the Telecommunications Act of 1996, particularly with respect to broadband. The overall thrust of the FCC's decision was to preserve voice competitors' access to key network facilities and to severely limit the options available to facilities-based data providers. The FCC's rationale was that its decision would free the incumbent Bell carriers from regulatory obligations in the hope that this will give them incentives to modernize their networks by investing in broadband facilities. There is little doubt that an appeal will follow this highly contentious decision, postponing much needed certainty in this beleaguered telecom sector.
