摘要

In Goldstein v. California, petitioners, in the business of making unauthorized sound recordings for sale, argued that a California law that provided copyright protection, which was more extensive than that provided by federal law, was impermissible under the Copyright Clause of the Constitution. The US Supreme Court found that the framers had not intended to create a solely federal system of copyright regulation and that the California statute that protected works fixed prior to February 15, 1972, was not precluded (unlike the federal Copyright Law). Therefore, court concluded that, "under the Constitution, the States have not relinquished all power to grant to authors 'the exclusive Right to their respective Writings."
