It was because of all of the foregoing defects in COPA that the Third Circuit, for the second time, held COPA unconstitutional, and set forth multiple grounds for its finding. On remand, the Third Circuit's findings are far broader than those in its first decision and which led to the Supreme Court granting certiorari and its subsequent remand. The court's reasoning is persuasive but another appeal to the Supreme Court is likely and the final word on COPA therefore is expected to be at least another year away.
