SUPER-DMCA: HAS IT LANDED IN YOUR STATE?

摘要

The status of super-DMCA legislation across the states is changing rapidly. However, in many jurisdictions it gives additional weapons to use in litigation in which DMCA-type claims are made. While largely based on the MPAA-backed Model Legislation, super-DMCA measures that have been enacted, or introduced as bills, still vary state-to-state in both scope and breadth. This broad range of potential application has raised a host of concerns, including whether currently legitimate security research may, in the future, be considered criminal. In addition, many super-DMCA critics are concerned with exactly how far certain companies, including entertainment and telecommunication service providers, might be able to use super-DMCA laws to control the future use of technology in the home. Given these uncertainties, it may be quite relevant and important for you to determine whether a super-DMCA has in fact landed in or is circling over your state.
