This article has argued that the expanded use of AI technology including automated decision-making systems has exacerbated existing discrimination in terms of employment, policing, data protection, and in warfare. International law via the UN has looked at the need to protect the right to privacy in the modern world and at present is being left behind because of the fast-moving advancement of technology and in particular the advancement of AI. The argument, however, moves away from privacy protection and technology to the very real threat of the increase of discrimination, targeted at groups already deeply effected by discriminatory societal factors. It could be argued that ethnic minorities and women already discriminated against due to existing biases will have these exacerbated by the increased use of AI technology. This is because of the design and operation of AI technology where data mining is conducted by small demographic mining data that is already biased. This operation puts data subjects at a disadvantage as it is difficult to identify where and how the AI technology has influenced the discriminatory result. Existing international human rights legislation has provided a foundation for protecting prohibited discrimination but as with the fundamental protection of privacy, it is not enough to deal with the violations exacerbated by AI technology.58 A new legal framework must focus on principles of accountability and transparency to achieve fairness and to ensure that companies' use of AI is regulated.
