The objective of State aid control is to ensure that government intervention does not distort competition and trade within the European single market. In this respect, State aid is defined as an advantage in any form whatsoever conferred on a selective basis to undertakings by national public authorities. The EC Treaty provides for the general prohibition of State aid. Nevertheless, the Treaty also leaves room for a number of policy objectives with which State aid can be considered compatible. In the field of public passenger transport, sector-specific legislation applies (Regulation 1370/2007). To be deemed compatible with State aid rules, public money or exclusive rights granted to an operator will have to be in line with the prescriptions of the Regulation. Although the Regulation has not yet entered into force, the services of the EU Commission harbour considerable doubts about some current practices.
