The holdings in Viking Resources regarding statutory interpretation and preemption are overshadowed by the court's dynamic decisions on the Seventh Amendment right to a jury trial. Either party can move for a jury trial, and with this court's holdings as precedent coupled with Supreme Court precedent, the motion will be difficult to deny. In the same vein, motions to bifurcate will likely be unsuccessful.
