The Court held that the FMSCA did not in fact violate NEPA in failing to issue an EIS for the regulations concerning the permission of Mexican trucking onto American soil. In overturning the Court of Appeals decision, the Supreme Court shed light on the legal role of the FMSCA in regulating federal environmental guidelines. Following the decision, any Mexican-domiciled trucks meeting regulatory standards are permitted to cross into American land, and inevitably, American air. Regarding the likely consequences of this case, the most immediately apparent effect is that it will put reduced demands upon agencies to ensure that they have complied with the EPA's regulations. Specifically, when the agency has no authority to prevent the environmental effects from occurring, the courts will defer to the agency in determining whether the industry's assessments of environmental effects are sufficient. This decision announces that a full and comprehensive EIS is not required in circumstances where the agency has no control over the implementation of the act it seeks to regulate. This evidences a considerable setback to environmentalists who wish to fully investigate all effects of Mexican trucking before carriers enter our borders.
