In light of the above, it is important to state that despite the confrontation between the industrialized and the developing countries all through the negotiating process, and the seemingly compromising language of the Convention, the Basel Convention remains the only global legal instrument regulating transboundary movement of hazardous, toxic and dangerous wastes and products. Its provisions ensure the protection of countries, particularly the developing countries, from the deluge of toxic and dangerous wastes and products illicitly dumped in their territories. It also ensures the promotion of environmentally sound waste disposal management and the minimization of waste generation. The control system ensures that the Convention does not remain a mere declaration of intention, but an obligation to ensure respect for the rights of countries. The Convention has been criticized, however, by the proponents of a complete ban of waste trade, such as the Greenpeace Movement. Greenpeace denounced the Convention as being an instrument of legalization of waste trade.331 Some critics predict compliance problems because no organizations currently exist to monitor compliance, to enforce the provisions or to prosecute violators. According to the Convention, disputes could either be settled through negotiation or any other peaceful means. If this is not possible and if the parties to the dispute agree, the dispute is submitted to arbitration or to the ICJ, but only if both parties consent to the jurisdiction of the ICJ.
