The claimant local planning authorities ("LPAs") applied to set aside a decision of the defendant Secretary of State refusing their claims for exemption of certain areas within their boroughs from the category of permitted developments not requiring planning permission. As a consequence of the Town and Country Planning (General Permitted Development) (Amendment) (England) Order 2013 (SI 2013/1101), the Town and Country Planning (General Permitted Development) Order 1995 (SI 1995/418) ("1995 Order") had been amended to include a change of use from office premises to dwelling houses as a permitted development. Prior to adoption of the 2013 Order, a consultation process was held and the Secretary of State referred to national planning policy, explaining that the measures were to reflect the Government's commitment to increase the supply of land for housing.
