The decision of Cranston J. in Bishop's Stortford Civic Foundation v East Hertfordshire DC explores the difficulties that arise when a local authority has to determine a planning application for development in which the authority is itself substantially involved. Where the local authority is in effect applying to itself for planning permission, the Town and Country Planning General Regulations 1992 lay down special procedures. It would appear that in the Bishop's Stortford case, the regulations did not apply as the application was made to East Hertfordshire by a private firm. However, it was a joint venture on a town centre site previously owned by the local authority. The facts were complicated but under a confidential agreement it had been agreed that the private company would lease the site from the local authority. The local authority would receive £2.3 million and had agreed to assist the company "wherever possible" to obtain planning consent for a mixed-use scheme.
