摘要

Despite the significant capital and operating expenditure savings and benefits available to operators from active infrastructure sharing as opposed to passive infrastructure sharing operators remain cautious over the perceived risks. In our opening article, Oliver Stacey, corporate finance partner at international legal practice Norton Rose LLP, draws on his considerable experience, including the merger of Orange UK and T-Mobile UK, to consider different mobile infrastructure sharing models and how the key risks can be managed. His discussion addresses a number of concerns for operators involved in successful active network sharing including ownership and right to use; transition to the new arrangements while ensuring no loss of service; securing access to the facilities; operation and maintenance; and termination of the arrangement.
