The exploitation of natural resources has always been one of the main engines of human development. Over the last centuries, activities in this field have been enabled by the existence of contractual arrangements and legal frameworks aimed at promoting and protecting private investments. Cross-border flows are of paramount importance because natural resources - just like capital - are not distributed evenly among nations. Foreign investment law facilitates the movement of capital towards developing countries blessed with natural riches but limited funds to explore and manage them properly. This book is the translation of Professor Nakagawa's first academic monograph, published in Japanese in 1990. Its publication in English makes this study available to a broader audience, offering a glimpse into the historical evolution of international investment law between resource nationalism and greater liberalisation. The book examines the regulatory frameworks governing foreign direct investment in natural resource development, focusing essentially on two key issues: how investment contracts are regulated in this field of activity; and how disputes emerging from the nationalisation of natural resources are settled between host states and foreign investors.
