The dispute settlement procedures of the World Trade Organization (WTO) allow countermeasures to be imposed when a country fails to provide temporary trade compensation and at the same time is unwilling to comply with the rulings and recommendations of the Dispute Settlement Body (DSB). Increasingly sceptical about the efficiency and effectiveness of these two remedies, debates in the context of the current Doha mandate have resulted in several proposals. Apart from the fact that the current system of retaliation has been widely criticized as being the antithesis of the raison d'etre of the WTO, some of the proposals, such as tradable retaliation and pre-authorized trade compensation, though greatly welcomed by some Members, have also been criticized by others, who feel that they would, inter alia, encroach on the sovereignty of countries. Being conscious of the first ten years experimental phase of the WTO and its system of remedies for responding to continuous non-compliance, this article examines the main objective and problems associated with the WTO retaliation in the context of the international law theories of compliance. The article therefore looks at why Pre-authorized Contingent Financial Commitment (PCFC) could be a solution to the WTO remedies problems from both developed and developing countries' perspectives. The article ends with some notes of appraisal and caution.
