Secularity and religious freedom are at the core of the identity of modern democracies. Their coupling, however, generates a double dilemma: In order to constitute itself as ‘secular’, the secular state is not only dependent on having a concept of ‘religion’ as its negative reference. To be in the position of guaranteeing religious freedom, it needs to define religion in a positive way, too. Whoever wants to enforce laws guaranteeing religious freedom, must first provide evidence that he or she actually has religion in the limits of what the secular state defines as religion. The secular state, thus, offends against both the principle of secularity and the right to religious freedom in the sense of religious self-determination.
