Congress significantly expands the rights of individuals and small businesses to recover their attorneys fees after proving regulatory citations or prosecutions were unjustified. Under the old Equal Access to Justice Act (EAJA), employers had to win the underlying case defense and nearly prove frivolousness in order to be eligible for attorney fee awards.
